Wesley Chapel Elder Law Attorney

Elder law is a broad term used to describe everything from establishing legal guardianship to long term care planning. As we age, it becomes increasingly important to address many of the inevitable difficulties that we face. From exploitation and elder abuse and end of life care, to asset protection and choosing a retirement home right for you, our Wesley Chapel elder law attorneys here at The Law Office of Laurie R. Chane can help you through the most basic to the most advanced elder law issues that you may be facing.

Elder Law Services We Provide

The National Academy of Elder Law Attorneys reports that 11.9 percent of total spending by older Americans is on their health. This number only increases with age. As such, asset protection and qualifying for healthcare services such as Medicaid and Medicare is very important, and is something our attorneys can help you achieve. We also provide the following services, and more:

  • Asset protection;
  • Long-term care planning;
  • Medicaid and Medicare assistance;
  • Estate planning;
  • Updating estate plans;
  • Estate administration;
  • Nursing home, assisted living, and independent living assistance;
  • Living wills, advance healthcare directives, powers of attorney;
  • Healthcare proxies;
  • Trusts;
  • Elder abuse and exploitation protection; and
  • Legal guardianships

Veterans Affairs

Veterans and spouses of veterans who have recently passed away may be entitled to VA pensions and Aid & Attendance benefits. Our attorneys can help you determine if you are eligible for additional benefits and ensure that you are provided with the maximum compensation you are entitled to.

Long Term Care Planning

Most people do not have the financial resources to pay for long term care planning, which can cost over $100,000 per year. Medicare only pays for short stays, not long term housing in a nursing home, assisted living facility, or independent living residence. Medicaid does pay for these long term care options, but is available only to those with virtually zero financial assets. This leaves the majority of people out in the cold. However, by creating a Medicaid trust, you can hold onto your assets and still qualify for long term care Medicaid assistance.

Why Getting a Head Start Can Help You Later

According to the Population Reference Bureau, 20.5 percent of Florida’s population is currently over the age of 65. While most people do not feel that old at 65, this is the point at which your future, and the financial future of your beneficiaries, needs to be carefully considered. Long term care planning, which often requires planned gifting or creating a Medicaid trust, needs to start well before your potential move to a long term care residence. Similarly, asset protection through the creation of various trusts, can start well in advance of your later Golden Years.
